INTRODUCTION

The CCOHS legislation monthly report helps you track the legislative changes occurring in Canadian jurisdictions in January 2018. To assist you in tracking changes to this report, the updated information will appear in purple. Information contained in this report is restricted to environmental/health and safety legislation that is either available in the Canadian enviroOSH Legislation series or represents new items. We welcome your comments on this service. You can contact us at clientservices@ccohs.ca

Each jurisdiction contains information on the following:

1. Legislation in progress/proposed

1A. Acts

Contains the names of current federal, provincial and territorial bills relevant to the Canadian enviroOSH Legislation series. It is updated monthly. All bills are removed at the conclusion of a parliamentary session and a new series begins.

Note: If a bill has reached "Royal assent" this does not necessarily mean it is in force (effective). The notation NIF indicated Not in Force (i.e. will be proclaimed later).

Internet addresses containing proposed bills have been provided for those jurisdictions which supply this information. Please note that the bills are not official versions and that "first reading" bills may be amended.

1B. Regulations

List of proposals for amendments to current regulations or for new regulations. Some items may represent officially gazetted regulations which have yet to come into force. Summaries are included where available.

2. Amendments

Contains information about amendments which have come into force in January 2018. These amendments have been incorporated in the respective legislation by CCOHS staff.

3. Repealed Legislation

Lists documents repealed by the respective jurisdictions and removed from the Canadian enviroOSH Legislation series as of January 2018 under which they were made (Governing Act).

4. New documents

Documents that will be included in the Canadian enviroOSH Legislation collection. Please note that some items represent previously existing legislation to increase comprehensiveness while others are newly enacted legislation. Information is presented under the respective jurisdiction as follows: Title of the document, Governing Act (if necessary), and Citation.

Section 2.B Canada Regulations

Domestic Substances List (Canadian Environmental Protection Act, 1999) (SOR/94-311): SOR/2017-280 adds 5 substances to Part 1 , adds 3 substances to Part 3 and 1 substance to Part 4. SOR/2017-281 adds 2 substances to Part 1.

Prohibition of Certain Toxic Substances Regulations, 2012 (Canadian Environmental Protection Act, 1999): SOR/2017-247 replaces subsection 9(3) relating to temporary permitted uses in Section 9 Requirement for permit.

Règlement sur certaines substances toxiques interdites (2012)

Transportation of Dangerous Goods Regulations (Transportation of Dangerous Goods Act, 1992): SOR/2017-253 makes amendments related to marine provisions to update terms which are no longer used in the Canada Shipping Act, 2001 (CSA 2001) and associated regulations, in particular, the Cargo, Fumigation and Tackle Regulations (CFTR) and the Vessel Certificates Regulations (VCR). The amendments are intended to harmonize and reduce confusion regarding certain requirements.

Section 2.A British Columbia Acts

Carbon Tax Act : Two amendments have been applied. S.B.C. 2017, c. 10 corrects the word "self propelled" to "self-propelled" in Section 1. S.B.C. 2017, c. 12 repeals Part 2 and adds to the Tables in both Schedules 1 and 2.

Drinking Water Protection Act : S.B.C. 2016, c. 20 repeals and replaces subsection 24(1)(a)(ii).

Environmental Management Act : S.C. 2016, c. 20 is in force (except s. 3 insofar as it repeals s. 79) makes several amendments, including the addition of Division 2.1 (Spill Preparedness, Response and Recovery) to Part 7.

Motor Vehicle Act : S.B.C. 2017, c. 10 makes some minor word corrections.

Private Managed Forest Land Act : S.B.C. 2017, c. 10 makes minor wording changes in a few sections.

Protected Areas of British Columbia Act : S.B.C. 2017, c. 10 corrects some spelling in Schedule C.

Railway Act : S.B.C. 2017, c. 10 makes a minor word correction in Section 2.

Weed Control Act : S.B.C. 2017, c. 10 makes minor word correction in Section 3.

Section 2.B British Columbia Regulations

Organic Matter Recycling Regulation (Environmental Management Act): B.C. Reg. 243/2016 comes into force 01/11/17 adding s. 34 (Transition - matters in progress), repealing Schedules 9 and 10 and adding Schedule 10.1 (Soil Substance Concentration).

Occupational Health and Safety Regulation (Workers' Compensation Act): B.C. Reg. 143/2017 came into force 01/01/18 and adds Section 4.43.1 Storage racks.

Section 2.A Ontario Acts

Building Code Act, 1992 : S.O. 2017, c. 34, Sch. 2 applies various amendments to this Act.

Coroners Act : S.O. 2017, c. 34, Sch. 46 repeals and replaces the definition of ‘Minister’ in Section 1, and replaces subsection 8(7) referring to annual report requirements for the Oversight Council.

Green Energy Act, 2009 : S.O. 2017, c. 34, Sch. 18 adds Part III.1 Energy Data, and adds to Section 16 Regulations.

Occupational Health and Safety Act : S.O. 2017, c. 34, Sch. 30 makes various amendments including adding Section 53.1 Additional notices.

Santé et la sécurité au travail (Loi sur la), L.R.O. 1990, chap. O.1

Provincial Offences Act : S.O. 2017, c. 34, Sch. 35 repeals and replaces the definition of "prosecutor" in Section 1, adds Section 91.1 Set fines, and applies various other amendments to this Act.

Workplace Safety and Insurance Act, 1997 : The three following amendments have been applied.

1) S.O. 2017, c. 8, Sch. 33 (various sections) amend Section 13 Insured injuries as related to benefits and mental stress; and, add subsections to Section 43 Payments for loss of earnings and to Section 46 Compensation for non-economic loss.

2) S.O. 2015, c. 38, Sch. 23 repeals and replaces Section 49 General indexing; repeals Section 50 Alternate indexing factor; repeals several subsections in Section 51 Indexation of amounts in the Act; repeals and replaces Section 52 Annual adjustment of payments and Section 52.1 Regulations re temporary indexing factor and additional adjustment; and, applies many other amendments.

3) S.O. 2017, c. 34, Sch. 45 amends Section 13 to provide that a worker is entitled to benefits for mental stress under subsection 13(4) as if the mental stress were a personal injury by accident. Adds a new Section 13.1 Transition rules re mental stress that sets out the transitional rules that apply for the purpose of determining entitlement to benefits under subsection 13(4) (mental stress). Adds a new Section 173.1 Tribunal may contract that provides that the Appeals Tribunal may contract with any other person for any purpose that the chair considers necessary, and the Appeals Tribunal is deemed to be a person for the purposes of the contract and is a party to the contract. Amends Section 174 Hearing of appeals to provide that the chair of the Appeals Tribunal may appoint a panel of three or five members to hear and decide an appeal or other matter conferred upon the Appeals Tribunal.

Section 2.A Quebec Acts

Act respecting labour standards : S.Q. 2017, c. 29 is in force adding paragraph 17 to the definition of "employer subject to contribution" in s. 39.0.1.

Loi sur les normes du travail

Building Act : S.Q. 2017, c. 21 amends s. 65.4 to reflect changes to the organization and governance of the health and social services network, in particular, the abolishment of the regional agencies. S.Q. 2017, c. 27 s. 162 is in force adding a paragraph at the end of s. 65.2.1. regarding a holder’s licence which has been restricted and the holder is also ineligible for public contracts under Chapter V.1 of the Act respecting contracting by public bodies.

Loi sur le bâtiment

Public Health Act : S.Q. 2017, c. 21 amends wording in ss. 82, 100, 136 and 138 regarding a medical biology laboratory or laboratory medicine department.

Section 2.B Quebec Regulations

Regulation respecting a cap-and-trade system for greenhouse gas emission allowances (Environment Quality Act): O.C. 1125-2017 is in force except s. 59 making extensive amendments to the regulation.

Regulation respecting mandatory reporting of certain emissions of contaminants into the atmosphere (Environment Quality Act): M.O. 2017 is in force Jan. 1, 2018 making amendments to harmonize with major amendments made to the Regulation respecting a cap-and-trade system for greenhouse gas emission allowances.
